Terms of use.

Notarize.co.ke is a platform through which Advocates of the High Court of Kenya, holding current practising certificates, perform notarial acts remotely over a recorded video session. These terms govern your use of this website and of the notarial services booked through it.

By creating an account, booking an appointment, or submitting a document, you accept these terms. If you do not accept them, do not use the service.

We provide notarial acts: verification of the signer's identity, witnessing of execution, administration of oaths and affirmations, and attestation under the advocate's seal. Where you request it and pay the published fee, we also provide drafting of standard instruments.

We do not provide legal advice. Nothing on this website and nothing said in a session constitutes advice on the merits, wisdom, tax treatment, or consequences of your transaction. No advocate-client relationship on the merits of your matter arises from a notarial act performed through this platform. If you need advice, instruct an advocate separately.

A notary may decline to perform an act where identity cannot be satisfactorily established, where the signer appears not to understand the document or not to be acting freely, where the document is incomplete or unlawful, or where the instrument requires physical execution.

You must provide accurate and complete information, and a valid, current, government-issued photo identification that belongs to you. Presenting another person's identification, or a forged or altered document, is a criminal offence and will be reported.

You are responsible for the content and accuracy of every document you upload. We check documents for completeness and suitability for the notarial act requested; we do not verify the truth of their contents, and a notarized document is not a certificate that its contents are true.

You must attend the session yourself, in a private setting, with a working camera and microphone, and be able to understand the language in which the session is conducted. Tell us in advance if you need an interpreter.

You may not upload malicious files, attempt to access another user's booking or documents, probe or interfere with the platform's security, or use the service to facilitate fraud or money laundering.

Appointments are booked into 30-minute slots displayed in East Africa Time. Selecting a slot places a short hold on it; the hold is reserved for you once you submit your booking.

You may move a confirmed appointment yourself, free of charge, up to 24 hours before it starts. Your payment carries over to the new time.

Each booking includes one free late change. Moving an appointment less than 24 hours before it starts, or failing to attend, uses that allowance. Where it is used, we will hold your payment and you may rebook within 7 days at no extra cost.

If a second appointment on the same booking is missed, or you do not rebook within 7 days, the session fee is forfeited and the booking is closed. This reflects the notary time reserved and not used.

A slot reserved for a booking that remains unpaid may be released once the appointment window has passed.

Your notary will wait 10 minutes from the appointment start time before a session is treated as missed. Where a session cannot proceed because of a failure on our side, we reschedule at no charge or refund the fee.

Fees are the flat amounts published on the Fees page at the time of booking. Payment is taken by M-Pesa or card after your documents have been reviewed and before the session is confirmed.

Where authentication or legalization involves Ministry of Foreign Affairs, consular, or embassy charges, those are pass-through costs, quoted separately, and not part of our fee.

If we are unable to perform the notarial act for a reason attributable to us, the fee is refunded in full. Where a notary declines to act for one of the reasons in section 2, or where you supplied inaccurate information or failed to attend, the fee is not refundable. There is no charge for re-submitting corrected documents after a review note.

We retain your documents, the record of the session, and the event log of the matter as evidence of the notarial act. These records exist so that the act can be defended if a registry, counterparty, or court later questions it, and may be produced for that purpose or where the law requires it.

Our handling of your personal data and documents, including encryption and retention, is described in our Security and Legality page. You retain ownership of your documents; we hold them to perform the service and to keep the notarial record.

We attest to what a notary can properly attest to. We do not control, and cannot guarantee, whether a particular registry, government department, foreign authority, bank, or counterparty will accept a given document, or whether they will impose an additional requirement such as an apostille, consular legalization, or physical execution.

Where we are aware of such a requirement for your destination, we will tell you before you book. Where you know of one, tell us.

We aim to keep the service available but do not warrant uninterrupted availability. Sessions depend on your device, camera, and internet connection, none of which are within our control. Where a session cannot proceed because of a failure on our side, we will reschedule at no charge or refund the fee.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for a notary's professional negligence to the extent the law provides.

Subject to that, our liability arising out of or in connection with a matter is limited to the fees you paid for that matter. We are not liable for indirect or consequential loss, including lost profit, lost opportunity, delay in a transaction, or loss arising from a third party's refusal to accept a document.

We may suspend or close an account where these terms are breached, where there are reasonable grounds to suspect fraud or identity misrepresentation, or where required by law. Closure does not affect the notarial records we are required to keep.

We may update these terms as the service and the applicable law develop. The terms in force at the time you book govern that booking. Material changes will be signposted on this page.

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute arising from them. The professional conduct of an advocate on our roll remains subject to the Advocates Act and the oversight of the Law Society of Kenya.
